Quelle est l'évolution du droit international des droits de l'homme à propos du prononcé ou de l'exécution de la peine capitale? La tendance abolitionniste progresse nettement en Europe, plus lentement au niveau universel. Mais, au minimum, la privation de la vie ne doit pas être arbitraire et, si la condamnation à mort n'est pas universellement interdite, elle ne peut résulter que d'une procédure judiciaire dont les garanties (indépendance et impartialité du tribunal, système de preuve, droits de la défense...) doivent être rigoureusement respectées. Quels sont les autres éléments d'évolution?

Le présent colloque organisé par la Doyen Gérard Cohen-Jonathan (Centre de recherche sur les droits de l'homme et le droit humanitaire de Paris II, CRDH) et le Professeur William Schabas (Centre des droits de l'homme de l'Université nationale d'Irlande, Galway) tente d'en approfondir les données à travers l'interaction des juridictions internationales, les grands traités, la pratique diplomatique et les principes généraux du droit.

What is the evolution of the international law of human rights concerning the death penalty and its execution? The abolitionist trend progresses quickly in Europe but more slowly on the global level. But at least, the deprivation of life is not be imposed arbitrarily and if the death penalty is not universally prohibited, it can only result from a judicial procedure which guarantees must be strictly respected (namely independence and impartiality of the court, evidence and rights of the defence). What are the elements of evolution?

This conference was organised by Dean Gérard Cohen-Jonathan (CRDH) and Professor William Schabas (Irish Centre for Human Rights, National University of Ireland) and sought to examine the data thorougly through the interaction of international courts, major treaties, diplomatic practice and the general principles of law.
